Implied Consent Hearings are administrative hearings conducted before an Office of Motor Vehicles Hearing Officer. The issue for the hearing officer to determine at an Implied Consent Hearing (ICH) is whether your license to drive in South Carolina was properly suspended based on what occurred shortly after you were placed under arrest for DUI. Because of the specific issue for the hearing officer to decide, not everyone charged with DUI needs to request an ICH. The need to request an ICH applies only those who either refused to blow into the Datamaster machine or did blow into the Datamaster machine and registered a .15 or higher.
